International Maintenance Recovery on the Basis of Authentic Instruments

The payment of child maintenance is not always ordered by a court. Maintenance debtors may commit themselves to make these payments in an enforceable deed, also called authentic instrument. In case of non-payment, enforcement can basically be carried out in the same way as on the basis of a court decision.
Regarding cross-border cases, the enforcement of child maintenance claims on the basis of authentic instruments is mentioned in Art. 48 of Regulation (EC) No. 4/2009 and in Art. 30 of the 2007 Hague Child Support Convention. However, there is still a lack of international awareness as regards the nature of authentic instruments. This leads to a certain degree of skepticism regarding the conditions under which they are established as well as to a number of obstacles at the level of recognition, declaration of enforceability and enforcement. The conference aims to provide information on these two topics and to allow an exchange between the stakeholders involved on both levels.
Prerequisites for participation are a terminal device (PC, laptop or smartphone) with audio input and output and the use of Zoom.
