International Maintenance Recovery by Public Bodies

Aufgrund der Zunahme staatlicher Unterstützungssysteme bei Ausfall von Kindesunterhaltszahlungen und der Mobilität von Familien wächst der Bedarf an grenzüberschreitender Durchsetzung von Unterhaltsansprüchen durch öffentliche Träger. Es entsteht ein Spannungsverhältnis zwischen dem Bedürfnis nach einer zeitnahen und angemessenen Unterstützung der Kinder, nach einer effektiven Refinanzierung des Unterhalts durch Rückgriffmaßnahmen und dem Schuldnerschutz. Die Konferenz bildet den Abschluss einer Reihe von drei Seminaren zum Thema Unterhaltsgeltendmachung durch öffentliche Stellen und soll einen Einblick in die gesellschaftspolitischen und rechtlichen Aspekte sowie eine einmalige Gelegenheit zum Austausch mit Expert:innen aus verschiedenen Bereichen bieten. Tagungssprache ist Englisch.
Due to the proliferation of state support systems in case of default of child maintenance payments and the increase in international mobility of families, the need for cross-border enforcement of maintenance by public authorities is growing. A tension arises between the need for more immediate support for children, for an effective reimbursment of maintenance allowance from debtors and debtor protection, especially when it is no longer the child alone but an authority that asserts maintenance payments. The conference concludes a series of three seminars on the topic of maintenance recovery by public bodies and is intended to provide insight into its socio-political and legal aspects as well as a unique opportunity for an exchange with experts from different fields. The conference will be hold in English.
